1. How Personal Information is maintained
a. Collection: obtaining personal information from any source, including third parties, by any means.
b. Consent: the granting of voluntary permission regarding the collection, use and disclosure of personal information for defined purposes. Consent can be either express or implied.
c. Disclosure: to make known personal information to a third party.
d. Personal Information: information about an identifiable individual, but does not include the name, title, or business address or telephone number of an employee of an organization.
e. Use: the treatment, handling and management of personal information by and within Can-Am.
2. Who are we?
Can-Am is a fruit and vegetable distribution company in the greater Montreal area, and importer of specialty items from national and international markets. Through its national and international distribution networks, we have the ability to provide complete service offering needed to cover the greater Montreal area, including the Laurentians.
3. What personal information do we collect?
Canadian privacy legislation defines personal information broadly as information about "an identifiable individual" or as information that allows an individual to be identified. The types of personal information that we may collect from you from time to time include: your name, address, telephone number, e-mail address, your forwarding address (e.g. during a vacation), previous address(es), payment information (for billing purposes), mailing preferences, delivery instructions, and individual customer service preferences (such as "do not solicit"). In addition, from time to time, we may ask you to provide us with more detailed information regarding your interests and background. For example, we may sometimes ask our customers to complete surveys in order to get a better sense of who they are and what issues, products or services may be of interest to them and our readership. Finally, from time to time, we may acquire demographic and other information about you (e.g. your interests) from an outside organization, but only if you have previously agreed to allow such an organization to disclose the information to companies such as Can-Am.
4. Why do we collect your personal information?
We collect your personal information for the purposes listed below:
a. To provide the product and/or service you requested
If you are a customer, we use your name and address (postal and/or email) in order to deliver the product and/or service you requested and to follow up with you about the transaction (i.e., send a bill, statement of accounts, products available, etc.). If you enter into a contest offered through our sales team, we use your personal information to administer the contest on our own behalf.
b. To process payment
Your credit card number, debit card number, or banking information for pre-authorized payments is used only for processing payments and for presenting you with payment options - not for marketing purposes.
c. To send you information
From time to time we may send you further information about Can-Am, its offers, or other available products.
d. Other purposes
In addition, from time to time, we may use your personal information for the following purposes:
• To detect and protect Can-Am and other third parties against error, fraud, theft and other illegal activity, and to audit compliance with Can-Am policies and contractual obligations;
• To understand your needs and preferences, including to contact and communicate with you and to conduct surveys, research and evaluations;
• To obtain audited statements regarding numbers of subscribers per publication;
• To engage in business transactions, including the purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, securitization or financing involving Can-Am;
• For any other purpose we may indicate to you from time to time.
5. To whom do we disclose your personal information?
We may disclose your personal information to the following third parties in the following circumstances:
a. Disclosure to Service Providers
We may disclose your personal information to other companies that provide services on our behalf, including agricultural farmers, auditors, our software developers (including website developers and hosts), data processing, document management and office services. In addition, we may disclose your personal information to an organization or individual retained by Can-Am to evaluate your creditworthiness or to collect debts outstanding on an account or to our auditors. We will only provide those companies the information they need to deliver the service and they are prohibited from using that information for any other purpose.
b. Disclosure to Trading Partners
From time to time we may make their list of customers available to other carefully screened organizations (such as, other distributors, growers and charities) that want to let you know about a product or service that might interest you. The material to be sent to you is reviewed by us before the names and addresses (including e-mail addresses) are released to ensure the organization is reputable and material is appropriate and not misleading.

6. Law Enforcement and Legal Disclosure
Can-Am may disclose your personal information to a government institution that has asserted its lawful authority to obtain the information or where Can-Am has reasonable grounds to believe the information could be useful in the investigation of unlawful activity, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records and information, or to Can-Am's legal counsel.
If you would prefer for us NOT to share your information as described above in sections 4(a)-4(d), simply inform us.
7. Control of your personal information
At Can-Am, we want you to be able to maintain control over how we use your personal information. In particular:
a. You may have the right to "opt out" of some or all of the identified purposes, uses and disclosures listed in sections 3 and 4 above.
b. You always have the option to instruct us not to use your name, address, e-mail address, etc. beyond providing you with the product, service or information you requested.
c. E-mail communications will always include an identification of the sender and an "Unsubscribe" option.
d. We regularly use the Canadian Marketing Association "do not mail/do not call" service to remove customers from marketing campaigns. To add your name to this list, see "Canadian Marketing Association" below.
As mentioned above, we may not be able to provide you with our services if you withdraw your consent to our use of your personal information.
8. Where is your personal information stored?
Your personal information is stored in secured locations and on servers controlled by Can-Am, located either at our offices or at the offices of our service providers. For access to your personal information, please contact us.
9. Guidelines for Internet/Website Users
a. Can-Am does not collect identifying information about visitors to our website. We may collect non-identifying information about our visitors in order to create summary statistics and to determine the level of interest in information available on our site. This information would include such items as the date and time our site was accessed and the web browser used. Can-Am collects information about user's site usage through our server log files, including IP Addresses. Our website does not link IP Addresses to any personally identifiable information. In some cases, users' non-personal information may be automatically collected through the standard operation of Can-Am Internet servers.
b. Please be advised that information voluntarily disclosed online in discussion areas or other public areas of our website can be collected, used and disclosed by third parties. Any submissions made to discussion areas or other public areas on our website are done at the user's risk and on the understanding that such information may be accessible to third parties. Can-Am will not be liable or held responsible for any damages that may result from such user activity.
